We were able to determine that a basic error in the conveyancing process during the sale of the land led to a misunderstanding over the extent of the Scheduled area. And there is the crux of it. No way to prove the landowner knew their responsibilities if they weren't clearly told during conveyanci...

Sounds a lot like the owner realised he was about to banned from demolishing so got in there asap.

I think Scheduled Monument consent should be a matter of public record. Have you used www.whatdotheyknow.com?
